»Fundamental Rights and Private Law – The Emergence of Constitutional Private Law«: This thesis explores the emergence of a new layer of private law, which mainly stems from the case law of constitutional courts. It can be referred to as ›constitutional private law‹. While claiming that they are merely interpretating the constitution, constitutional courts effectively create and modify legal positions conferred on parties by private law. Their decisions can therefore be regarded as a source of private law. The thesis examines the extent to which constitutional private law can be integrated into the existing private law system.
