»Flexibilisation of Urban Planning Law. Constitutional and EU Law Scope for Exemptions from Urban Planning Law Provisions«: Once designed to address atypical situations in urban planning law, the legislator has transformed the exemption (Befreiung) into a far-reaching tool to increase flexibility in urban planning law. Critics, however, have repeatedly raised constitutional and EU law concerns against such a far-reaching mandate for deviations from the applicable zoning plans. Against this backdrop, this thesis undertakes a fundamental reconstruction of the legal framework for exemptions from urban planning law provisions.
