»Liability for climate change in civil law«: The discussion of the impacts of climate change has been occupying legal science for several years. With the Shell decision of the Rechtbank Den Haag in the Netherlands, it seems possible to activate civil law to combat climate change. This study takes up the following issue: Is it possible to use civil law provisions to oblige emitters to adjust their emissions to the 1.5 degree Celsius target? The decisive factor is the interpretation of Article 20a Grundgesetz by the Federal Constitutional Court
