»Distribution Restrictions in the Banking Sector«: The study is dedicated to supervisory restrictions on distributions, which are critically examined with regard to the target provisions of banking supervisory law. The study focuses in particular on the dual role of the ECB between monetary policy and banking supervision as well as the macroprudential regulatory approach. The author pleads for a legal framework for such measures combined with a legal definition of permissible objectives.
